IL COVID-19 Rebuttable Presumption Set to End

As Illinois employers and insurers are all too aware, during the January Session, the IL General Assembly approved HB 4276 and the Governor signed PA 101-653 into law which extended the COVID rebuttable presumption provision under the Workers’ Occupational Diseases Act to June 30, 2021. During the Spring Session, however, the legislature declined to allow the presumption to extend beyond tomorrow’s sunset.

In other words, beginning on July 1, 2021, claimants with allegations of COVID infection due to a workplace exposure will once again bear the burden of having to prove their claims.
